1. Introduction and Acceptance

These Terms and Conditions govern access to and use of https://abconceptae.com (the “Website”) and purchases made through it.

The Website is operated by Bassatne General Trading Co. L.L.C., trading as ABConcept Gold Store AE (“ABConcept”, “we”, “us” or “our”), a business based in Dubai, United Arab Emirates (“UAE”).

By accessing the Website, placing an order or purchasing a product, you (“Customer” or “you”) agree to these Terms and Conditions and the applicable policies published on the Website.

Please read these Terms and Conditions carefully before placing an order. If you do not agree to them, you should not proceed with a purchase.

These Terms and Conditions must be read together with our Shipping & Policies page, Privacy Policy, and any product-specific terms displayed at checkout. In the event of a conflict, applicable UAE law will prevail.

Nothing in these Terms and Conditions excludes, restricts or limits any consumer right or obligation that cannot lawfully be excluded, restricted or limited under applicable law.

2. Products and Product Information

ABConcept offers gold bars, silver bars, investment coins, collectible coins, limited-edition releases and other precious-metal products sourced from recognised mints and suppliers.

We endeavour to ensure that product descriptions, weights, metal purity, dimensions, minting years, packaging details, photographs, videos and prices are accurate and current.

Product photographs and videos are provided to help customers assess an item before purchasing. Minor differences in lighting, colour representation, packaging, presentation or subsequent manufacturer packaging updates may occur, provided the product supplied conforms to its material description and applicable legal requirements.

Product packaging varies. Depending on the item, a product may be supplied in a manufacturer-sealed assay card, certificate card, capsule, protective pouch or other packaging. Serial numbers and certificates are not available with every product. Customers should review the individual product description before ordering.

Any certificate, assay card, serial number or manufacturer packaging is supplied only where specified for the relevant product.

We do not knowingly offer counterfeit products or locally minted replicas represented as genuine products from another mint. Our products are sourced through our supply chain and supported by relevant source or import documentation, as applicable.

3. Precious Metals and Market-Sensitive Pricing

3.1 Market price fluctuations

Gold, silver and other precious metals are subject to continuous market movements. Their prices may fluctuate due to international spot prices, foreign exchange rates, supplier premiums, fabrication costs, collector demand, mintages, scarcity, shipping expenses, insurance, taxes, duties and other commercial factors.

The price displayed for a product is ABConcept’s retail selling price, not a guaranteed future market value or a promise of investment performance.

3.2 Price at checkout

The applicable price for an order is the price displayed at checkout when the order is accepted by ABConcept, subject to applicable law and the provisions of these Terms and Conditions.

Adding a product to a cart, saving it to a wishlist or viewing it on the Website does not reserve the product or lock its price.

Where a price is expressly quoted as an indicative price or is subject to confirmation, the customer must receive and accept the confirmed price before the order becomes binding.

3.3 Price changes before an order is accepted

Prices may change before an order is accepted, including because of movements in the underlying precious-metal market or changes in supplier costs.

If a material pricing error occurs or the displayed price is clearly incorrect, ABConcept may contact the customer before accepting the order to confirm the correct price or cancel the affected order and refund any amount paid, subject to applicable law.

ABConcept will not unilaterally increase the agreed price of an accepted order solely because the market price subsequently moves.

3.4 Market movements after purchase

Once an order has been accepted at an agreed price, subsequent increases or decreases in the market price of gold, silver or a collectible do not, by themselves, entitle either party to reprice the transaction.

Customers acknowledge that the resale value of precious metals and collectible coins may rise or fall after purchase.

ABConcept does not guarantee that a product can be resold at its purchase price, at its metal content value or at any particular future price.

3.5 No investment advice or guaranteed returns

Information on the Website is provided for general product and educational purposes only. Unless expressly agreed in writing and legally authorised, ABConcept does not provide personalised investment, financial, tax or legal advice.

Purchasing precious metals or collectible coins involves market, liquidity, premium, currency and resale risks. Collectible products may trade at premiums or discounts to their underlying metal value.

Past prices, historical performance, limited-mintage status and projected market trends do not guarantee future performance.

Customers are responsible for assessing their financial circumstances and obtaining independent professional advice where appropriate.

3.6 Taxes and additional charges

Product prices and checkout totals will identify applicable charges in accordance with the Website’s pricing presentation and applicable law. The Website states that prices include applicable customs, taxes and payment-processing charges for the relevant offering.

Any charge that is not included in the displayed price must be disclosed before the customer completes the purchase, where required by law.

Cross-border shipments may be subject to destination-country import duties, taxes, customs clearance charges or other mandatory fees as described in the shipping information and checkout.

4. Orders and Order Acceptance

Orders must be placed through the Website. Contacting ABConcept through WhatsApp, email or another communication channel does not, by itself, constitute a completed purchase.

After submitting an order, the customer may receive an automated order acknowledgement. An acknowledgement confirms receipt of the order request and does not necessarily constitute final acceptance.

An order is accepted when ABConcept confirms acceptance, subject to any disclosed verification, payment or compliance requirements.

ABConcept reserves the right to decline or cancel an order where reasonably necessary because of stock unavailability, an obvious pricing or listing error, suspected fraud, failed payment, unsuccessful customer verification, legal or regulatory requirements, or a material delivery restriction.

If payment has already been received for an order that ABConcept cancels, the amount paid for the cancelled order will be refunded, subject to applicable law.

Where only part of an order cannot be fulfilled, ABConcept may contact the customer to agree on an appropriate solution, including partial fulfilment or cancellation of the affected items.

5. Availability and Pre-Orders

Product availability may change without notice. A product displayed on the Website may become unavailable before an order is accepted.

Products marked “Sold Out”, “Out of Stock” or similar are not available for immediate purchase unless the Website expressly provides otherwise.

Certain supplier-available products may be available for pre-order by arrangement. Pre-orders require the deposit or advance payment specified by ABConcept, which may be 100% of the agreed purchase price.

Before accepting a pre-order, ABConcept will communicate any material conditions, including the confirmed price, anticipated availability, estimated fulfilment date and applicable cancellation or refund terms.

Estimated availability dates are not guaranteed unless expressly confirmed as binding. If ABConcept cannot fulfil an accepted pre-order, it will contact the customer to arrange a refund or another mutually agreed solution, subject to applicable law.

6. Payment Methods

Available payment methods may include:

• Online card payment through the Website’s payment gateway.
• Cash on delivery, where available and approved.
• Card payment on delivery, where available.
• Bank transfer or bank deposit.
• Tabby instalment payments, subject to provider approval, eligibility and availability in the applicable country.

Payment methods may vary by product, order value, destination and customer eligibility.

Online card transactions are processed by the relevant payment service provider. ABConcept does not intentionally collect or store full payment card credentials where these are processed directly by the payment provider.

For bank transfers, an order will ordinarily be processed for dispatch after the payment has been received and verified in ABConcept’s designated business account.

For cash-on-delivery orders, ABConcept may require a valid UAE phone number, Emirates ID copy and proof of address, subject to applicable legal requirements and the stated verification process.

Customers using third-party instalment services are also subject to the applicable provider’s terms. ABConcept does not control the provider’s approval decision or account servicing.

7. Customer Verification, AML and Compliance

To comply with applicable UAE laws, including relevant anti-money-laundering, counter-terrorist-financing and customer due-diligence requirements, ABConcept may require identity verification before accepting, processing or delivering an order.

Depending on the transaction and applicable requirements, customers may be asked to provide:

• A valid Emirates ID or passport.
• A UAE contact number and proof of address, where required.
• Additional information concerning the source of funds, beneficial ownership or purpose of the transaction.
• For qualifying corporate transactions, relevant trade licence, tax registration and ultimate beneficial ownership information.
• A completed and signed Know Your Customer (KYC) form or other supporting documents.

The Website currently states that orders exceeding AED 55,000 require additional ultimate beneficial ownership and corporate documentation, as applicable. This threshold is a stated business procedure and does not limit ABConcept’s ability or obligation to conduct additional verification where required by law or justified by transaction-specific risk.

Customers must provide accurate, complete and current information. ABConcept may pause processing, request further documentation or decline or cancel a transaction where verification cannot be completed or where required by applicable law.

If an order is cancelled following a compliance review, any refund will be handled in accordance with applicable law and any lawful restrictions imposed by competent authorities.

8. Shipping, Delivery and Collection

8.1 UAE deliveries

ABConcept ordinarily aims to deliver UAE orders within 24–48 hours, subject to order confirmation, payment clearance, verification, stock availability, the delivery address and courier operations.

The Website currently states that UAE orders above AED 500 qualify for free delivery. Applicable delivery charges will be displayed at checkout or otherwise communicated before the order is completed.

The stated delivery windows are estimates unless a specific delivery commitment has been expressly confirmed. Customers will be contacted to coordinate delivery where appropriate.

8.2 GCC and international deliveries

Delivery to eligible GCC destinations may be available, including Saudi Arabia, Qatar, Bahrain, Kuwait and Oman.

International shipments are subject to the destination country’s import regulations, customs requirements, courier restrictions and product eligibility.

International orders generally require prepayment. Unless expressly stated otherwise at checkout, the recipient is responsible for destination-country import duties, taxes and other charges not included in the order total.

If a courier or competent authority refuses or prohibits a shipment, ABConcept will contact the customer and arrange an appropriate solution, including a refund where applicable.

Where an international shipment is returned or cannot be delivered because of an inaccurate address, customer unavailability, failure to provide required documents, refusal to accept delivery or failure to pay applicable destination charges, reasonable documented costs incurred may be deducted from any refund only to the extent permitted by applicable law and disclosed shipping terms.

8.3 Delivery appointments

Deliveries are carried out through courier partners or other designated delivery arrangements. Requests for a particular time slot will be passed to the courier where practicable but cannot be guaranteed unless expressly confirmed.

8.4 Delivery address and recipient

Customers must provide an accurate delivery address, contact number and any other information reasonably required for safe delivery.

Customers must ensure that an authorised recipient is available to receive the shipment and complete any required verification.

For high-value shipments, ABConcept or its delivery partner may require identity verification, a signature or other reasonable proof of receipt.

8.5 Risk and proof of delivery

ABConcept will comply with applicable legal requirements concerning delivery, loss and damage.

The transfer of risk will be determined in accordance with applicable law and the agreed delivery arrangements. A courier tracking status alone will not override a customer’s statutory rights.

Customers should promptly notify ABConcept of apparent shipping damage, missing items, tampering or non-delivery and retain the packaging and relevant evidence. Such notification does not limit any statutory remedy.

8.6 Collection

Where store or office collection is offered at checkout, customers must wait for confirmation of the collection appointment and follow the identity-verification and collection instructions provided by ABConcept.

9. Order Cancellation

A customer may request cancellation at any time before delivery by contacting ABConcept using the contact details published on the Website.

ABConcept will confirm whether the order can be cancelled and whether any refund is due under these Terms and Conditions and applicable law.

Where cancellation is accepted before delivery, ABConcept will refund amounts due in accordance with applicable law and the disclosed refund process. Any deduction must be lawful, justified and disclosed; no deduction will be made where prohibited by law.

For pre-orders, cancellation is subject to the specific terms communicated and agreed before the pre-order is accepted, together with applicable statutory rights.

ABConcept may cancel an order for a lawful reason, including non-payment, failed verification, suspected fraud, product unavailability, an obvious listing error or a legal or regulatory restriction. If payment has been received, the refund will be handled in accordance with applicable law.

10. Returns, Refunds and Defective Products

10.1 General return policy

Due to the market-sensitive nature of precious metals and the importance of maintaining product authenticity and packaging integrity, ABConcept generally does not accept discretionary returns of delivered bullion, coins or collectible products merely because a customer changes their mind, no longer wants the product or is dissatisfied with a subsequent market-price movement.

This policy is subject to any mandatory rights available under applicable UAE consumer-protection legislation, including rights concerning defective, non-conforming, misdescribed or otherwise legally returnable goods.

10.2 Defective, damaged or misdescribed products

If a product is defective, materially different from its description, damaged in transit or otherwise fails to conform to applicable legal requirements, the customer should contact ABConcept promptly with the order number, a description of the issue and supporting photographs or other relevant evidence.

ABConcept will investigate the matter and provide the remedy required by applicable law. Depending on the circumstances and the applicable legal requirements, the remedy may include repair, replacement, a price adjustment, cancellation or a refund.

A product will not be treated as defective solely because the market price of the underlying metal or the collectible value has increased or decreased.

10.3 Packaging and product integrity

Customers should inspect the external packaging upon receipt, where reasonably practicable, and promptly report visible damage or signs of tampering.

Manufacturer-sealed assay cards, protective packaging, capsules and certificates form part of the product presentation where specified. Customers should avoid opening, altering or damaging sealed packaging before reporting a suspected authenticity or conformity issue, as doing so may complicate verification.

Opening packaging does not automatically extinguish statutory rights relating to a genuine defect, misdescription or other non-conformity.

10.4 Refund processing

Where a refund is approved or legally required, ABConcept will communicate the applicable process and expected processing arrangements.

Refunds will ordinarily be made through the original payment method where practicable, subject to payment-provider procedures and applicable law.

The time taken for the refunded amount to appear in the customer’s account may depend on the bank, card issuer or payment service provider.

10.5 No guaranteed buy-back

ABConcept does not operate a guaranteed buy-back programme and is not obliged to repurchase products solely because a customer wishes to sell them after delivery.

Any future purchase of previously sold products by ABConcept would be subject to a separate assessment, agreed pricing, product condition, verification and applicable legal requirements.

11. Product Authenticity and Verification

ABConcept takes reasonable steps to source products through recognised mints, authorised suppliers or established precious-metal supply channels.

Product details and accompanying documentation will be provided as applicable to the item purchased.

Where a customer raises a reasonable concern about authenticity, ABConcept may request the product, its packaging, order documentation or other relevant evidence for examination.

Any examination or verification process will be conducted consistently with applicable law and the customer’s statutory rights.

Nothing in this section limits ABConcept’s legal obligations concerning authenticity, product conformity, commercial fraud or consumer protection.

12. Customer Responsibilities

Customers agree to:

1. Provide accurate and complete order, contact, delivery and verification information.
2. Use a valid payment method authorised for the transaction.
3. Purchase products only for lawful purposes.
4. Cooperate with reasonable identity, payment and compliance checks.
5. Review product specifications, packaging details, delivery charges and applicable terms before completing checkout.
6. Notify ABConcept promptly of suspected unauthorised transactions, delivery problems or material order discrepancies.

Customers must not misuse the Website, interfere with its security or functionality, submit fraudulent orders, impersonate another person or use the Website in violation of applicable law.

13. Promotions, Discounts and Limited Releases

Promotional offers, discount codes, bundles, limited releases and other special offers may be subject to separate conditions, eligibility requirements and availability limits.

Unless expressly stated otherwise, promotions cannot be combined with other offers and are not redeemable for cash.

A promotion does not override the agreed price of an already accepted order unless the parties agree otherwise or applicable law requires it.

ABConcept may discontinue or amend future promotions, subject to any commitments already made and applicable law.

14. Website Content and Intellectual Property

The Website’s text, photographs, videos, graphics, logos, designs, product listings and other original materials are owned by or licensed to ABConcept or the relevant rights holders.

Third-party brand names, mint names, trademarks, product designs and images remain the property of their respective owners and are used for identification, product description or other lawful purposes.

Customers may use the Website for personal, lawful browsing and purchasing. No Website content may be reproduced, commercially exploited, distributed or modified without the relevant rights holder’s prior permission, except as permitted by law.

15. Privacy and Personal Information

ABConcept may collect and process personal information necessary to manage orders, process payments, arrange delivery, verify identity, prevent fraud, meet legal obligations and provide customer support.

Information may be shared with payment processors, delivery companies, verification providers, professional advisers and competent authorities where reasonably necessary and legally permitted.

16. Website Availability and Electronic Communications

ABConcept endeavours to maintain the Website and its ordering functions but does not guarantee uninterrupted availability, error-free operation or compatibility with every device.

Temporary interruptions may occur because of maintenance, technical faults, payment-provider outages, security incidents or circumstances beyond reasonable control.

Customers agree that order acknowledgements, order updates, invoices and other transaction-related communications may be provided electronically where permitted by law.

Electronic communications do not remove any applicable legal requirement concerning invoices, disclosures or customer consent.

17. Limitation of Liability

To the extent permitted by applicable law, ABConcept will not be liable for indirect or consequential losses arising from a customer’s independent investment decisions, anticipated resale profits, changes in precious-metal prices or collector-market valuations.

Nothing in these Terms and Conditions excludes or restricts liability for fraud, wilful misconduct, obligations that cannot lawfully be excluded, or any other liability that applicable law requires ABConcept to retain.

ABConcept does not guarantee investment returns or future resale prices. This does not affect its obligations to supply products that conform to their description and applicable legal requirements.

18. Events Beyond Reasonable Control

Where fulfilment is delayed or prevented by circumstances beyond ABConcept’s reasonable control, including severe disruption to transport, customs restrictions, government action, supplier interruption, payment-network failure or other exceptional events, ABConcept will take reasonable steps to inform affected customers and mitigate the impact.

This section does not permit ABConcept to disregard mandatory consumer rights or retain payments where a refund is legally due.

19. Amendments to These Terms

ABConcept may update these Terms and Conditions to reflect changes in its operations, products, payment methods, shipping arrangements or applicable law.

The current version will be published on the Website with its effective or last-updated date.

Revised terms will apply to future orders from their effective date. Unless required or permitted by law, changes will not retrospectively alter the agreed terms of an already accepted order.

20. Governing Law and Disputes

These Terms and Conditions are governed by the applicable laws of the United Arab Emirates.

Any dispute will be addressed through good-faith communication between the customer and ABConcept in the first instance.

Where a dispute cannot be resolved amicably, it may be referred to the competent courts or relevant dispute-resolution authorities in the UAE, subject to applicable law and any mandatory consumer-jurisdiction protections.

Nothing in this section prevents a customer from exercising a statutory right to submit a complaint to a competent UAE consumer-protection authority.

21. Severability and Waiver

If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, where legally permitted. The remaining provisions will continue to apply.

A failure or delay by ABConcept in enforcing a provision does not constitute a waiver of its rights.

22. Entire Agreement

These Terms and Conditions, together with the applicable product details, order confirmation and policies expressly incorporated into the transaction, constitute the terms governing the relevant purchase.

If a specific written agreement accepted by both parties expressly modifies a provision of these Terms and Conditions, that agreement will apply to the extent of the modification and subject to applicable law.

2. المنتجات ومعلوماتها

تقدم ABConcept منتجات تشمل سبائك الذهب والفضة، والعملات الاستثمارية، والعملات التذكارية، والإصدارات محدودة العدد، وغيرها من منتجات المعادن الثمينة.

نبذل جهوداً معقولة لضمان دقة أوصاف المنتجات وبيانات الوزن ونقاء المعدن والأبعاد وسنوات الإصدار وتفاصيل التغليف والصور ومقاطع الفيديو والأسعار، مع الحرص على تحديثها عند الحاجة.

تُعرض الصور ومقاطع الفيديو لمساعدة العملاء على تقييم المنتجات قبل الشراء. وقد تظهر اختلافات طفيفة في الألوان أو الإضاءة أو طريقة العرض أو التغليف نتيجة ظروف التصوير أو تحديثات التغليف من الشركة المصنّعة، شريطة أن يطابق المنتج المُسلّم وصفه الجوهري والمتطلبات القانونية المعمول بها.

تتخذ ABConcept إجراءات معقولة لتجنب عرض منتجات مقلدة أو نسخ محلية يُدّعى خطأً أنها منتجات أصلية صادرة عن دور سك العملة الأخرى. ويتم توريد المنتجات عبر قنوات التوريد الخاصة بالشركة، مع الاحتفاظ بالمستندات ذات الصلة بالمصدر أو الاستيراد، بحسب مقتضى الحال.

3. الأسعار الحساسة لتقلبات السوق والمعادن الثمينة

3.1 تقلبات أسعار السوق

تخضع أسعار الذهب والفضة والمعادن الثمينة الأخرى لتقلبات مستمرة في الأسواق. وقد تتغير الأسعار نتيجة تحركات الأسعار الفورية العالمية، وأسعار صرف العملات، وهوامش الموردين، وتكاليف التصنيع، والطلب من هواة الجمع، وندرة المنتجات، ورسوم الشحن والتأمين، والضرائب والرسوم الجمركية، وغيرها من العوامل التجارية.

السعر المعروض للمنتج هو سعر البيع بالتجزئة الذي تحدده ABConcept، ولا يمثل ضماناً لقيمته السوقية المستقبلية أو وعداً بتحقيق عائد استثماري معين.

3.2 السعر المعتمد عند إتمام الطلب

يكون السعر المطبق على الطلب هو السعر المعروض عند إتمام عملية الشراء، عند قبول ABConcept للطلب، مع مراعاة القوانين المعمول بها والأحكام الواردة في هذه الشروط.

إن إضافة منتج إلى سلة التسوق أو حفظه في قائمة الرغبات أو الاطلاع عليه في الموقع لا يعني حجزه أو تثبيت سعره.

إذا تم عرض سعر على أنه استرشادي أو خاضع للتأكيد، فيجب إبلاغ العميل بالسعر النهائي وتأكيد موافقته عليه قبل أن يصبح الطلب ملزماً.

3.3 تغيّر الأسعار قبل قبول الطلب

قد تتغير الأسعار قبل قبول الطلب، بما في ذلك نتيجة تحركات أسعار المعادن الثمينة أو تغير تكاليف الموردين.

إذا ظهر خطأ جوهري في التسعير أو كان السعر المعروض غير صحيح بصورة واضحة، يجوز لـ ABConcept التواصل مع العميل قبل قبول الطلب لتأكيد السعر الصحيح، أو إلغاء الطلب المتأثر ورد أي مبلغ تم تحصيله، وذلك وفقاً للقوانين المعمول بها.

ولا يجوز لـ ABConcept زيادة السعر المتفق عليه من جانب واحد بعد قبول الطلب لمجرد حدوث تغير لاحق في أسعار السوق.

3.4 تحركات السوق بعد الشراء

بعد قبول الطلب بالسعر المتفق عليه، لا تمنح الزيادة أو الانخفاض اللاحق في أسعار الذهب أو الفضة أو قيمة العملات التذكارية، بحد ذاتها، أي طرف الحق في إعادة تسعير المعاملة.

يقر العميل بأن القيمة عند إعادة بيع المعادن الثمينة والعملات التذكارية قد ترتفع أو تنخفض بعد الشراء.

لا تضمن ABConcept إمكانية إعادة بيع أي منتج بسعر الشراء أو بقيمة محتواه المعدني أو بأي سعر مستقبلي محدد.

3.5 عدم تقديم المشورة الاستثمارية أو ضمان العوائد

تُقدم المعلومات المنشورة على الموقع لأغراض التعريف بالمنتجات والتوعية العامة فقط. وما لم يتم الاتفاق صراحةً على خلاف ذلك كتابةً وكان ذلك مسموحاً به قانوناً، لا تقدم ABConcept مشورة استثمارية أو مالية أو ضريبية أو قانونية مخصصة.

ينطوي شراء المعادن الثمينة والعملات التذكارية على مخاطر تتعلق بتقلبات السوق والسيولة وهوامش الأسعار والعملات وقيم إعادة البيع. وقد تُباع المنتجات التذكارية بعلاوات سعرية أو بخصومات مقارنة بقيمة المعدن الذي تحتوي عليه.

لا يشكل الأداء التاريخي أو الأسعار السابقة أو محدودية عدد الإصدارات أو اتجاهات السوق المتوقعة ضماناً للأداء المستقبلي.

يتحمل العميل مسؤولية تقييم ظروفه المالية والحصول على مشورة مهنية مستقلة عند الاقتضاء.

3.6 الضرائب والرسوم الإضافية

تُعرض أسعار المنتجات وإجمالي المبالغ المستحقة عند إتمام الطلب بطريقة توضح الرسوم المطبقة وفقاً لعرض الأسعار على الموقع والقوانين المعمول بها.

يشير الموقع إلى أن الأسعار تشمل الرسوم الجمركية والضرائب ورسوم معالجة الدفع المطبقة على العرض المعني. وأي رسوم غير مشمولة في السعر المعروض يجب الإفصاح عنها قبل إتمام العميل للشراء، متى كان ذلك مطلوباً قانوناً.

قد تخضع الشحنات العابرة للحدود لرسوم استيراد أو ضرائب أو رسوم تخليص جمركي أو رسوم إلزامية أخرى في بلد الوجهة، وفقاً لما توضحه معلومات الشحن وعملية إتمام الطلب.

4. الطلبات وقبولها

يجب تقديم الطلبات من خلال الموقع الإلكتروني. ولا يُعد التواصل مع ABConcept عبر واتساب أو البريد الإلكتروني أو أي قناة اتصال أخرى، في حد ذاته، عملية شراء مكتملة.

بعد إرسال الطلب، قد يتلقى العميل إشعاراً آلياً باستلامه. ويؤكد هذا الإشعار استلام طلب الشراء، لكنه لا يعني بالضرورة قبوله نهائياً.

يُعتبر الطلب مقبولاً عندما تؤكد ABConcept قبوله، مع مراعاة أي متطلبات معلنة تتعلق بالتحقق من الهوية أو الدفع أو الامتثال.

تحتفظ ABConcept بالحق في رفض الطلب أو إلغائه عند وجود سبب معقول، بما في ذلك عدم توفر المخزون، أو وجود خطأ واضح في السعر أو بيانات المنتج، أو الاشتباه في الاحتيال، أو فشل الدفع، أو تعذر إتمام التحقق من العميل، أو وجود متطلبات قانونية أو تنظيمية، أو قيود جوهرية على التسليم.

إذا تم استلام الدفع عن طلب ألغته ABConcept، فسيُرد المبلغ المدفوع عن الطلب الملغى وفقاً للقوانين المعمول بها.

إذا تعذر تنفيذ جزء من الطلب فقط، يجوز لـ ABConcept التواصل مع العميل للاتفاق على حل مناسب، بما في ذلك تنفيذ الجزء المتاح أو إلغاء المنتجات المتأثرة.

5. التوفر والطلبات المسبقة

قد يتغير توفر المنتجات دون إشعار مسبق. وقد يصبح المنتج المعروض على الموقع غير متوفر قبل قبول الطلب.

المنتجات التي تحمل عبارة «نفد المخزون» أو «غير متوفر» أو ما يماثلها لا تكون متاحة للشراء الفوري، إلا إذا نص الموقع صراحةً على خلاف ذلك.

قد تتوفر بعض المنتجات من خلال الموردين بنظام الطلب المسبق وبموجب اتفاق مسبق. وتتطلب الطلبات المسبقة دفع العربون أو المبلغ المقدم الذي تحدده ABConcept، وقد يصل إلى 100% من سعر الشراء المتفق عليه.

قبل قبول الطلب المسبق، ستوضح ABConcept للعميل الشروط الجوهرية ذات الصلة، بما في ذلك السعر المؤكد، والتوفر المتوقع، وموعد التنفيذ التقديري، وشروط الإلغاء أو الاسترداد المطبقة.

تُعد مواعيد التوفر المقدرة غير مضمونة ما لم يتم تأكيدها صراحةً باعتبارها مواعيد ملزمة. وإذا تعذر على ABConcept تنفيذ طلب مسبق مقبول، فستتواصل مع العميل لترتيب استرداد المبلغ أو الاتفاق على حل بديل، وفقاً للقوانين المعمول بها.

6. طرق الدفع

قد تشمل طرق الدفع المتاحة ما يلي:

• الدفع بالبطاقات عبر بوابة الدفع الإلكتروني للموقع.
• الدفع نقداً عند الاستلام، حيثما كان متاحاً ومعتمداً.
• الدفع بالبطاقة عند الاستلام، حيثما كان متاحاً.
• التحويل المصرفي أو الإيداع البنكي.
• خدمات الدفع بالتقسيط من Tabby، وفقاً لموافقة مقدم الخدمة والأهلية والتوفر في الدولة المعنية.

قد تختلف طرق الدفع بحسب المنتج وقيمة الطلب ووجهة التسليم وأهلية العميل.

تتم معالجة معاملات البطاقات الإلكترونية بواسطة مقدم خدمة الدفع المعني. ولا تتعمد ABConcept جمع أو تخزين بيانات البطاقة الكاملة عندما تتم معالجتها مباشرةً بواسطة مقدم خدمة الدفع.

بالنسبة إلى التحويلات المصرفية، تتم معالجة الطلب عادةً بغرض الشحن بعد استلام المبلغ والتحقق من إيداعه في الحساب التجاري المحدد لدى ABConcept.

بالنسبة إلى طلبات الدفع عند الاستلام، قد تطلب ABConcept رقم هاتف إماراتياً صالحاً ونسخة من الهوية الإماراتية وإثبات عنوان، وفقاً للمتطلبات القانونية وإجراءات التحقق المعلنة.

ويخضع العملاء الذين يستخدمون خدمات التقسيط التابعة لجهات خارجية لشروط تلك الجهات. ولا تتحكم ABConcept في قرارات الموافقة الصادرة عنها أو في إدارة حسابات العملاء لديها.

7. التحقق من العملاء ومكافحة غسل الأموال والامتثال

امتثالاً للقوانين المعمول بها في دولة الإمارات العربية المتحدة، بما في ذلك المتطلبات ذات الصلة بمكافحة غسل الأموال وتمويل الإرهاب وإجراءات العناية الواجبة تجاه العملاء، يجوز لـ ABConcept طلب التحقق من هوية العميل قبل قبول الطلب أو معالجته أو تسليمه.

بحسب طبيعة المعاملة والمتطلبات القانونية، قد يُطلب من العميل تقديم ما يلي:

• هوية إماراتية سارية أو جواز سفر.
• رقم اتصال إماراتي وإثبات عنوان، عند الحاجة.
• معلومات إضافية بشأن مصدر الأموال أو المستفيد الحقيقي أو الغرض من المعاملة.
• بالنسبة إلى معاملات الشركات التي تستوجب ذلك، الرخصة التجارية ذات الصلة والتسجيل الضريبي وبيانات المالكين المستفيدين النهائيين.
• نموذج اعرف عميلك (KYC) مكتمل وموقّع أو مستندات داعمة أخرى.

يشير الموقع حالياً إلى أن الطلبات التي تتجاوز قيمتها 55,000 درهم إماراتي تتطلب مستندات إضافية تتعلق بالمستفيد الحقيقي النهائي ووثائق الشركات، بحسب مقتضى الحال. ويُعد هذا الحد إجراءً تجارياً معلناً، ولا يحد من صلاحية ABConcept أو التزامها بإجراء تحقق إضافي عندما يقتضي القانون ذلك أو تبرره مخاطر المعاملة.

يجب على العملاء تقديم معلومات صحيحة وكاملة ومحدثة. ويجوز لـ ABConcept تعليق معالجة الطلب أو طلب مستندات إضافية أو رفض المعاملة أو إلغاؤها إذا تعذر إتمام التحقق أو اقتضت القوانين المعمول بها ذلك.

إذا أُلغي الطلب عقب مراجعة الامتثال، فستتم معالجة أي مبلغ مسترد وفقاً للقوانين المعمول بها وأي قيود قانونية تفرضها السلطات المختصة.

8. الشحن والتسليم والاستلام

8.1 التوصيل داخل دولة الإمارات

تسعى ABConcept عادةً إلى توصيل الطلبات داخل دولة الإمارات خلال 24 إلى 48 ساعة، وذلك رهناً بتأكيد الطلب وتصفية الدفعة وإتمام التحقق وتوفر المخزون وصحة عنوان التسليم وإجراءات شركة التوصيل.

يشير الموقع حالياً إلى أن الطلبات داخل دولة الإمارات التي تتجاوز قيمتها 500 درهم إماراتي مؤهلة للتوصيل المجاني. وتُعرض رسوم التوصيل المطبقة عند إتمام الطلب أو يتم إبلاغ العميل بها قبل إتمام الشراء.

تُعد المدد المذكورة تقديرية ما لم يتم تأكيد موعد تسليم محدد وملزم صراحةً. وسيتم التواصل مع العميل لتنسيق التسليم عند الاقتضاء.

8.2 الشحن إلى دول مجلس التعاون الخليجي والدول الأخرى

قد يتوفر الشحن إلى وجهات مؤهلة في دول مجلس التعاون الخليجي، بما في ذلك المملكة العربية السعودية وقطر والبحرين والكويت وسلطنة عُمان.

تخضع الشحنات الدولية للوائح الاستيراد في بلد الوجهة ومتطلبات الجمارك وقيود شركات الشحن وأهلية المنتج للشحن.

تتطلب الطلبات الدولية عادةً الدفع المسبق. وما لم يُنص صراحةً على خلاف ذلك عند إتمام الطلب، يتحمل المستلم مسؤولية رسوم الاستيراد والضرائب والرسوم الأخرى في بلد الوجهة التي لم تُدرج في إجمالي الطلب.

إذا رفضت شركة الشحن أو إحدى السلطات المختصة الشحنة أو حظرت نقلها، فستتواصل ABConcept مع العميل لترتيب حل مناسب، بما في ذلك رد المبلغ عند الاقتضاء.

إذا أُعيدت الشحنة الدولية أو تعذر تسليمها بسبب عنوان غير صحيح، أو عدم توفر العميل، أو عدم تقديم المستندات المطلوبة، أو رفض استلام الشحنة، أو عدم دفع الرسوم المستحقة في بلد الوجهة، فيجوز خصم التكاليف المعقولة والموثقة التي تكبدتها الشركة من أي مبلغ مسترد، بالقدر الذي تسمح به القوانين المعمول بها وشروط الشحن المعلنة.

8.3 مواعيد التسليم

تتم عمليات التسليم من خلال شركات التوصيل أو ترتيبات التسليم الأخرى المعتمدة. ويمكن نقل طلبات العملاء المتعلقة بموعد أو فترة تسليم معينة إلى شركة التوصيل متى كان ذلك عملياً، ولكن لا يمكن ضمانها ما لم يتم تأكيدها صراحةً.

8.4 عنوان التسليم والمستلم

يجب على العميل تقديم عنوان تسليم صحيح ورقم اتصال صالح وأي معلومات أخرى مطلوبة بصورة معقولة لضمان التسليم الآمن.

يتعين على العميل التأكد من وجود مستلم مخول باستلام الشحنة وإتمام أي إجراءات تحقق مطلوبة.

بالنسبة إلى الشحنات ذات القيمة المرتفعة، يجوز لـ ABConcept أو لشركة التوصيل طلب التحقق من الهوية أو توقيع المستلم أو أي إثبات معقول آخر على الاستلام.

8.5 المخاطر وإثبات التسليم

تلتزم ABConcept بالمتطلبات القانونية المعمول بها فيما يتعلق بالتسليم وفقدان المنتجات وتلفها.

يُحدد انتقال مخاطر الفقد أو التلف وفقاً للقوانين المعمول بها وترتيبات التسليم المتفق عليها. ولا تكون حالة تتبع الشحنة لدى شركة التوصيل وحدها كافية لتجاوز الحقوق القانونية للعميل.

ينبغي للعملاء إبلاغ ABConcept دون تأخير عن أي تلف ظاهر أثناء الشحن أو منتجات مفقودة أو عبوات تم العبث بها أو عدم استلام الشحنة، مع الاحتفاظ بالتغليف والأدلة ذات الصلة. ولا يؤدي هذا الإبلاغ إلى تقييد أي حق قانوني في التعويض أو المعالجة.

8.6 الاستلام من الموقع

إذا أُتيح استلام الطلب من المتجر أو المكتب عند إتمام الشراء، فيجب على العميل انتظار تأكيد موعد الاستلام واتباع تعليمات التحقق من الهوية والاستلام التي تقدمها ABConcept.

9. إلغاء الطلبات

يجوز للعميل طلب إلغاء الطلب في أي وقت قبل التسليم، وذلك بالتواصل مع ABConcept عبر بيانات الاتصال المنشورة على الموقع.

ستؤكد ABConcept ما إذا كان من الممكن إلغاء الطلب وما إذا كان هناك مبلغ مستحق للاسترداد بموجب هذه الشروط والأحكام والقوانين المعمول بها.

إذا تمت الموافقة على الإلغاء قبل التسليم، فسترد ABConcept المبالغ المستحقة وفقاً للقوانين المعمول بها وإجراءات الاسترداد المعلنة. ويجب أن يكون أي خصم قانونياً ومبرراً ومعلناً، ولا يجوز إجراء أي خصم يحظره القانون.

بالنسبة إلى الطلبات المسبقة، يخضع الإلغاء للشروط المحددة التي تم إبلاغ العميل بها والاتفاق عليها قبل قبول الطلب المسبق، مع مراعاة الحقوق القانونية الإلزامية.

يجوز لـ ABConcept إلغاء الطلب لسبب مشروع، بما في ذلك عدم الدفع أو فشل التحقق أو الاشتباه في الاحتيال أو عدم توفر المنتج أو وجود خطأ واضح في بيانات المنتج أو وجود قيد قانوني أو تنظيمي. وإذا تم استلام الدفع، فستتم معالجة الاسترداد وفقاً للقوانين المعمول بها.

10. الإرجاع والاسترداد والمنتجات المعيبة

10.1 سياسة الإرجاع العامة

نظراً للطبيعة الحساسة لتقلبات أسعار المعادن الثمينة وأهمية الحفاظ على أصالة المنتجات وسلامة تغليفها، لا تقبل ABConcept عموماً الإرجاع الاختياري لسبائك الذهب أو الفضة أو العملات أو المنتجات التذكارية التي تم تسليمها لمجرد تغيير رأي العميل أو عدم رغبته في المنتج أو انخفاض سعره في السوق بعد الشراء.

ويخضع ذلك لأي حقوق إلزامية مقررة بموجب تشريعات حماية المستهلك المعمول بها في دولة الإمارات العربية المتحدة، بما في ذلك الحقوق المتعلقة بالعيوب أو عدم مطابقة المنتج أو اختلافه جوهرياً عن وصفه أو الحالات الأخرى التي يجيز القانون فيها الإرجاع.

10.2 المنتجات المعيبة أو التالفة أو غير المطابقة للوصف

إذا كان المنتج معيباً أو مختلفاً اختلافاً جوهرياً عن وصفه أو تالفاً أثناء النقل أو غير مطابق للمتطلبات القانونية المعمول بها، فينبغي للعميل التواصل مع ABConcept دون تأخير، مع تقديم رقم الطلب ووصف للمشكلة وصور داعمة أو أدلة أخرى ذات صلة.

ستقوم ABConcept بالتحقيق في المسألة وتقديم المعالجة التي يقتضيها القانون. وقد تشمل المعالجة، بحسب الظروف والمتطلبات القانونية، الإصلاح أو الاستبدال أو تخفيض السعر أو إلغاء المعاملة أو رد المبلغ.

لا يُعتبر المنتج معيباً لمجرد ارتفاع أو انخفاض سعر المعدن الذي يحتوي عليه أو تغير قيمته لدى هواة الجمع.

10.3 التغليف وسلامة المنتج

ينبغي للعملاء، متى كان ذلك عملياً، فحص التغليف الخارجي عند الاستلام والإبلاغ دون تأخير عن أي تلف ظاهر أو علامات عبث.

تُعد بطاقات الفحص المختومة وعبوات الحماية والكبسولات والشهادات جزءاً من عرض المنتج عندما يُنص على توفرها. وينبغي للعملاء تجنب فتح التغليف المختوم أو تعديله أو إتلافه قبل الإبلاغ عن أي شك في الأصالة أو مطابقة المنتج، لأن ذلك قد يعقد عملية التحقق.

ولا يؤدي فتح التغليف تلقائياً إلى سقوط الحقوق القانونية المتعلقة بعيب حقيقي أو اختلاف جوهري في الوصف أو أي حالة أخرى من حالات عدم المطابقة.

10.4 معالجة المبالغ المستردة

عند الموافقة على الاسترداد أو وجوبه قانوناً، ستوضح ABConcept الإجراءات المتبعة والمدة المتوقعة لمعالجة الطلب.

تتم عمليات الاسترداد عادةً عبر وسيلة الدفع الأصلية متى كان ذلك عملياً، مع مراعاة إجراءات مزود الدفع والقوانين المعمول بها.

وقد تعتمد المدة اللازمة لظهور المبلغ المسترد في حساب العميل على البنك أو جهة إصدار البطاقة أو مزود خدمة الدفع.

10.5 عدم ضمان إعادة شراء المنتجات

لا تدير ABConcept برنامجاً مضموناً لإعادة شراء المنتجات، ولا تلتزم بإعادة شراء المنتجات لمجرد رغبة العميل في بيعها بعد التسليم.

وأي شراء مستقبلي لمنتجات سبق بيعها بواسطة ABConcept يخضع لتقييم مستقل وسعر متفق عليه والتحقق من حالة المنتج وأصالته والمتطلبات القانونية المعمول بها.

11. أصالة المنتجات والتحقق منها

تتخذ ABConcept خطوات معقولة للحصول على المنتجات من دور سك العملة المعروفة أو الموردين المعتمدين أو قنوات توريد المعادن الثمينة الراسخة.

تُقدم تفاصيل المنتج والمستندات المرفقة به، بحسب ما ينطبق على المنتج المشترى.

إذا أثار العميل مخاوف معقولة بشأن أصالة المنتج، فيجوز لـ ABConcept طلب المنتج أو تغليفه أو مستندات الطلب أو أدلة أخرى ذات صلة لفحصها.

تُجرى عمليات الفحص والتحقق بما يتوافق مع القوانين المعمول بها والحقوق القانونية للعميل.

ولا يحد أي حكم في هذا القسم من الالتزامات القانونية المترتبة على ABConcept فيما يتعلق بأصالة المنتجات أو مطابقتها أو الاحتيال التجاري أو حماية المستهلك.

12. مسؤوليات العميل

يوافق العميل على ما يلي:

1. تقديم معلومات صحيحة وكاملة بشأن الطلب وبيانات الاتصال والتسليم والتحقق.
2. استخدام وسيلة دفع صالحة ومصرح بها لإتمام المعاملة.
3. شراء المنتجات لأغراض مشروعة فقط.
4. التعاون مع إجراءات التحقق المعقولة المتعلقة بالهوية والدفع والامتثال.
5. مراجعة مواصفات المنتجات وتفاصيل التغليف ورسوم التسليم والشروط المطبقة قبل إتمام الطلب.
6. إخطار ABConcept دون تأخير بأي معاملة غير مصرح بها أو مشكلة في التسليم أو اختلاف جوهري في الطلب.

يُحظر على العميل إساءة استخدام الموقع أو التدخل في أمنه أو وظائفه أو تقديم طلبات احتيالية أو انتحال شخصية الغير أو استخدام الموقع بما يخالف القوانين المعمول بها.

13. العروض الترويجية والخصومات والإصدارات المحدودة

قد تخضع العروض الترويجية ورموز الخصم والباقات والإصدارات المحدودة والعروض الخاصة الأخرى لشروط منفصلة ومتطلبات أهلية وحدود للتوفر.

ما لم يُنص على خلاف ذلك صراحةً، لا يجوز الجمع بين العروض الترويجية المختلفة ولا استبدالها بمبالغ نقدية.

لا يؤدي أي عرض ترويجي إلى تعديل السعر المتفق عليه لطلب سبق قبوله، ما لم يتفق الطرفان على خلاف ذلك أو يقتضِ القانون ذلك.

يجوز لـ ABConcept إيقاف العروض المستقبلية أو تعديلها، مع مراعاة الالتزامات التي سبق التعهد بها والقوانين المعمول بها.

14. محتوى الموقع وحقوق الملكية الفكرية

تعود ملكية النصوص والصور ومقاطع الفيديو والرسومات والشعارات والتصاميم وقوائم المنتجات وغيرها من المواد الأصلية المنشورة على الموقع إلى ABConcept أو الجهات المرخصة لها.

تبقى أسماء العلامات التجارية وأسماء دور سك العملة والعلامات التجارية والتصاميم والصور التابعة لأطراف ثالثة ملكاً لأصحاب الحقوق المعنيين، ويجري استخدامها لأغراض التعريف أو وصف المنتجات أو غيرها من الأغراض المشروعة.

يجوز للعملاء استخدام الموقع للتصفح والشراء الشخصي والمشروع. ولا يجوز إعادة إنتاج محتوى الموقع أو استغلاله تجارياً أو توزيعه أو تعديله دون الحصول على إذن مسبق من صاحب الحقوق المعني، باستثناء الحالات التي يسمح بها القانون.

15. الخصوصية والمعلومات الشخصية

يجوز لـ ABConcept جمع المعلومات الشخصية ومعالجتها بالقدر اللازم لإدارة الطلبات ومعالجة المدفوعات وترتيب التسليم والتحقق من الهوية ومنع الاحتيال والوفاء بالالتزامات القانونية وتقديم دعم العملاء.

قد تتم مشاركة المعلومات مع مزودي خدمات الدفع وشركات التوصيل ومزودي خدمات التحقق والمستشارين المهنيين والسلطات المختصة، عندما يكون ذلك ضرورياً بصورة معقولة ومسموحاً به قانوناً.

تُعالج المعلومات الشخصية وفقاً لمتطلبات حماية البيانات المعمول بها في دولة الإمارات العربية المتحدة وسياسة الخصوصية الخاصة بـ ABConcept.

ينبغي للعملاء مراجعة سياسة الخصوصية للاطلاع على تفاصيل جمع البيانات واستخدامها والاحتفاظ بها وأمنها والحقوق المتعلقة بها.

16. توفر الموقع والاتصالات الإلكترونية

تبذل ABConcept جهوداً معقولة للحفاظ على الموقع ووظائف الطلبات، لكنها لا تضمن استمرارية توفره دون انقطاع أو خلوه من الأخطاء أو توافقه مع جميع الأجهزة.

قد تحدث انقطاعات مؤقتة بسبب الصيانة أو الأعطال الفنية أو انقطاع خدمات مزودي الدفع أو الحوادث الأمنية أو ظروف خارجة عن السيطرة المعقولة للشركة.

يوافق العملاء على إمكانية إرسال تأكيدات الطلبات وتحديثاتها والفواتير وغيرها من المراسلات المتعلقة بالمعاملات إلكترونياً، حيثما يسمح القانون بذلك.

ولا تلغي الاتصالات الإلكترونية أي متطلبات قانونية تتعلق بالفواتير أو الإفصاحات أو موافقة العميل.

17. حدود المسؤولية

بالقدر الذي تسمح به القوانين المعمول بها، لا تتحمل ABConcept المسؤولية عن الخسائر غير المباشرة أو التبعية الناتجة عن قرارات الاستثمار المستقلة التي يتخذها العميل أو الأرباح المتوقعة من إعادة البيع أو تغير أسعار المعادن الثمينة أو تغير تقييمات سوق هواة الجمع.

لا يستبعد أي حكم في هذه الشروط المسؤولية عن الاحتيال أو سوء السلوك المتعمد أو الالتزامات التي لا يجوز استبعادها قانوناً أو أي مسؤولية أخرى يوجب القانون على ABConcept تحملها.

لا تضمن ABConcept تحقيق عوائد استثمارية أو أسعار إعادة بيع مستقبلية. ولا يؤثر ذلك في التزاماتها بتوريد منتجات مطابقة لوصفها وللمتطلبات القانونية المعمول بها.

18. الظروف الخارجة عن السيطرة المعقولة

إذا تأخر تنفيذ الالتزامات أو تعذر بسبب ظروف خارجة عن السيطرة المعقولة لـ ABConcept، بما في ذلك الاضطرابات الشديدة في النقل أو القيود الجمركية أو الإجراءات الحكومية أو انقطاع التوريد أو تعطل شبكات الدفع أو غيرها من الظروف الاستثنائية، فستتخذ الشركة خطوات معقولة لإبلاغ العملاء المتأثرين والحد من آثار تلك الظروف.

ولا يسمح هذا القسم لـ ABConcept بتجاهل الحقوق الإلزامية للمستهلك أو الاحتفاظ بالمبالغ المدفوعة عندما يكون ردها واجباً قانوناً.

19. تعديل هذه الشروط والأحكام

يجوز لـ ABConcept تحديث هذه الشروط والأحكام لمواكبة التغييرات في عملياتها أو منتجاتها أو طرق الدفع أو ترتيبات الشحن أو القوانين المعمول بها.

ستُنشر النسخة الحالية على الموقع مع بيان تاريخ سريانها أو آخر تحديث لها.

تسري الشروط المعدلة على الطلبات المستقبلية اعتباراً من تاريخ سريانها. وما لم يقتضِ القانون أو يسمح بخلاف ذلك، لا تسري التعديلات بأثر رجعي لتغيير الشروط المتفق عليها لطلب سبق قبوله.

20. القانون الواجب التطبيق وتسوية النزاعات

تخضع هذه الشروط والأحكام للقوانين المعمول بها في دولة الإمارات العربية المتحدة.

تُعالج النزاعات في المقام الأول من خلال التواصل بحسن نية بين العميل وABConcept.

إذا تعذر حل النزاع ودياً، فيجوز إحالته إلى المحاكم المختصة أو الجهات المعنية بتسوية المنازعات في دولة الإمارات العربية المتحدة، مع مراعاة القوانين المعمول بها وأي قواعد إلزامية تتعلق بالاختصاص القضائي لحماية المستهلك.

ولا يمنع هذا القسم العميل من ممارسة حقه القانوني في تقديم شكوى إلى جهة مختصة بحماية المستهلك في دولة الإمارات العربية المتحدة.

21. قابلية الفصل وعدم التنازل

إذا تقرر أن أي حكم من هذه الشروط غير صالح أو غير قابل للتنفيذ، فيُفسر ذلك الحكم أو يُقيد بالحد الأدنى اللازم، حيثما يسمح القانون بذلك. وتظل الأحكام الأخرى سارية.

ولا يُعد عدم ممارسة ABConcept لأي حق أو تأخرها في ممارسته تنازلاً عن ذلك الحق.

22. الاتفاق الكامل

تشكل هذه الشروط والأحكام، إلى جانب تفاصيل المنتج المعمول بها وتأكيد الطلب والسياسات المشار إليها صراحةً في المعاملة، الشروط المنظمة لعملية الشراء ذات الصلة.

إذا تضمن اتفاق مكتوب محدد ومقبول من الطرفين تعديلاً صريحاً لأي حكم من هذه الشروط، فيُعمل بذلك الاتفاق في حدود التعديل، مع مراعاة القوانين المعمول بها.
